Welcome to Pool Wala. These Terms and Conditions (โ€œTermsโ€) govern your access to and use of the Pool Wala website, available at poolwala.in, and your enquiries for or use of services offered by Pool Wala.

By accessing this website, submitting an enquiry, communicating with us regarding a service, accepting a quotation or work order, or purchasing/using our services, you acknowledge that you have read and understood these Terms and agree to them, subject to applicable law.

These Terms should be read together with our Privacy Policy and any quotation, proposal, work order, invoice, service agreement or other written terms specifically issued for a project.

1. ABOUT POOL WALA

Pool Wala provides professional swimming pool related services and educational information. Depending on the project and location, our services may include swimming pool maintenance, water treatment, filtration and circulation support, equipment maintenance, troubleshooting, professional training, pool consultancy and other related swimming pool services.

Service availability, scope, pricing and timelines may vary depending on the site, pool condition, equipment, water source, location and client requirements.

2. WEBSITE INFORMATION

The information published on poolwala.in is provided for general informational and educational purposes.

Swimming pools differ in volume, design, filtration system, circulation, source water, usage, weather exposure, chemical history and equipment condition. Therefore, general information on this website should not automatically be treated as a site-specific chemical dose, engineering specification or guaranteed solution.

Where professional assessment is required, users should obtain appropriate site-specific advice before acting.

3. SERVICE ENQUIRIES AND QUOTATIONS

An enquiry made through our website, telephone, WhatsApp, email, social media or any other communication channel does not by itself create a binding service contract.

The final scope of work, quantities, specifications, rates, taxes, transportation, accommodation, material supply, exclusions, completion schedule and payment terms will be governed by the applicable quotation, proposal, work order, invoice or written confirmation.

Unless expressly stated otherwise in writing, additional work that falls outside the accepted scope may be charged separately after communication with the client.

4. SITE INSPECTION AND INFORMATION PROVIDED BY CLIENT

Quotations or recommendations may be prepared using information, photographs, videos, drawings, measurements or descriptions supplied by the client.

The client is responsible for providing materially accurate information about the pool, site, equipment, water source and existing conditions.

If actual site conditions differ materially from the information initially provided, Pool Wala may recommend changes to the scope, materials, method, price or schedule before carrying out affected additional work.

5. PAYMENTS

Payment schedules applicable to a particular project will be stated in the relevant quotation, invoice, work order or written confirmation.

Where a project specifically follows Pool Wala’s standard staged payment structure, the applicable quotation may provide for 50% advance on order confirmation, 40% before dispatch or when material is ready, and the remaining 10% after installation and handover.

However, individual maintenance, inspection, consultancy, training, repair or other assignments may have different payment terms. The terms stated in the accepted quotation or invoice for that assignment will prevail.

Work, procurement or dispatch may be scheduled after receipt of the applicable advance. Delayed payments may result in rescheduling or temporary suspension of work, subject to the agreed project terms and applicable law.

6. CANCELLATION, RESCHEDULING AND REFUNDS

Cancellation and refund eligibility depend on the nature and stage of the service.

Amounts already reasonably incurred towards site visits, travel, accommodation, customised work, labour mobilisation, procurement, specially ordered materials or services already performed may be taken into account when determining any applicable refund, subject to the agreed quotation and applicable law.

For training, inspection, consultancy or scheduled site visits, reasonable rescheduling may be permitted where mutually agreed.

Nothing in this section is intended to restrict any non-waivable rights available to consumers under applicable law.

7. SWIMMING POOL WATER TREATMENT

Water treatment results depend on several variables, including pool volume, pH, disinfectant level, total alkalinity, source-water quality, contamination load, filtration efficiency, circulation, weather, bather load, algae condition and previous chemical treatment.

Accordingly, no particular water-recovery time or chemical quantity should be treated as universally applicable unless it has been specifically assessed for the relevant pool.

Clients should follow the site-specific operating, dosing and safety instructions provided for their project.

8. CHEMICAL HANDLING AND SAFETY

Swimming pool chemicals can present health and safety risks if incorrectly stored, mixed, measured or handled.

Clients and site personnel are responsible for following product labels, manufacturer instructions, applicable safety requirements and any site-specific instructions provided by Pool Wala.

Different pool chemicals should not be mixed together unless the relevant manufacturer instructions and established professional procedure expressly permit it.

Pool chemicals should be stored securely and away from children, unauthorised persons, incompatible substances and unsuitable environmental conditions.

9. EQUIPMENT, ELECTRICAL AND PLUMBING CONDITIONS

Pool pumps, filters, valves, pipelines, electrical panels, underwater lights, dosing systems and other equipment may contain pre-existing defects, wear, corrosion, leakage, improper installation or concealed damage.

Where such conditions become apparent during inspection, servicing or repair, additional corrective work may be recommended and, where outside the agreed scope, separately quoted.

Electrical work must be performed with appropriate isolation and safety precautions. Equipment should not be operated contrary to manufacturer specifications or professional instructions.

10. THIRD-PARTY PRODUCTS AND MANUFACTURER WARRANTIES

Pool Wala may supply, install, recommend or work with equipment and materials manufactured by third parties.

Where a manufacturer provides a warranty, its coverage, exclusions, duration and claim process are governed by that manufacturer’s applicable warranty terms.

Pool Wala does not independently extend a manufacturer’s warranty unless a separate written warranty is expressly provided by Pool Wala.

Damage caused by misuse, dry running, incorrect voltage, improper operation, unauthorised modification, poor source-water conditions, external electrical faults, lack of maintenance or other causes outside the agreed service scope may not be covered, subject to the applicable warranty and law.

11. MAINTENANCE SERVICES

The exact activities and frequency included in a maintenance service are determined by the selected maintenance plan, quotation or written agreement.

A maintenance visit does not guarantee that water or equipment will remain unchanged between visits. Pool conditions can change due to rainfall, dust, source water, bather load, power failure, equipment malfunction, unauthorised chemical addition or other external factors.

The client should promptly inform Pool Wala of significant changes or equipment faults noticed between scheduled visits.

12. CLIENT RESPONSIBILITIES AND SITE ACCESS

The client should provide safe and reasonable access to the work area, pump room and relevant equipment at the agreed time.

Unless otherwise agreed, the client is responsible for informing Pool Wala about known concealed pipelines, electrical cables, structural elements and other site-specific hazards or restrictions that could materially affect the work.

Where required for the agreed work, appropriate electricity, water supply, drainage access and necessary site permissions should be made available.

Pool Wala may pause work where an unsafe condition creates a material risk to personnel, property or equipment until the condition is appropriately addressed.

13. PROJECT TIMELINES

Any estimated completion date may depend on material availability, site readiness, approvals, access, weather, transportation, third-party suppliers and other circumstances.

Pool Wala will make reasonable efforts to meet agreed schedules, but a reasonable revision may be required where delay results from circumstances outside our reasonable control or from client-requested changes.

14. TRAINING AND CONSULTANCY

Training and consultancy provided by Pool Wala are intended to provide practical professional guidance based on the information and conditions available at the time.

Implementation remains dependent on actual site conditions, equipment specifications, water parameters, operating practices and the actions of site personnel.

Where conditions materially change, additional assessment or revised recommendations may be necessary.

15. EDUCATIONAL CONTENT AND SOCIAL MEDIA

Articles, videos, reels, posts, demonstrations and other educational content published by Pool Wala are intended for general education and awareness.

Such content does not replace a site inspection, equipment manufacturer’s instructions, professional engineering advice where required, or applicable safety requirements.

Users should verify pool volume, chemical concentration, equipment specifications and actual water-test results before applying technical information to a particular pool.

16. INTELLECTUAL PROPERTY

Unless otherwise stated, original website content, Pool Wala branding, logos, graphics, photographs, videos, educational materials, training materials and other original content are owned by or licensed to Pool Wala and are protected to the extent provided by applicable intellectual property law.

Content may be viewed and shared through normal website or social-media sharing functions for lawful personal use. It may not be copied, reproduced, republished, sold, commercially exploited or represented as another person’s or organization’s original work without appropriate permission where such permission is required.

19. NO GUARANTEE OF UNCHANGED RESULTS

Pool Wala aims to provide professional services using reasonable skill and care.

However, swimming pool water and equipment operate in changing environmental and operational conditions. Unless a specific written performance commitment is included in an accepted contract, no statement on the website should be interpreted as a guarantee that a particular pool condition, water parameter or equipment performance will remain unchanged indefinitely.
